Los requisitos legales y técnicos son la base de los sistemas de gestión:
Seguramente has conocido multitud de empresas que inician a trabajar sin analizar antes los requerimientos legales y técnicos que deben implementar y luego tienen que enfrentarse a sanciones, multas o como mínimo sobre costos por tener que corregir errores en construcciones, metodologías, materiales, etc., que, de haberse contemplado desde el inicio fácilmente se podrían cumplir sin dolores de cabeza.
Lo mismo pasa con los sistemas de gestión; cada empresa es particular, está afectada no solo por el sector económico en que trabaja, sino también por su infraestructura, tamaño y muchas otras variables que cambian los requerimientos técnicos o legales a contemplar; la labor de un responsable del sistema de gestión es identificar claramente dichas necesidades, formar a los trabajadores y poner en práctica las acciones necesarias para el cumplimiento. Es importante tener en cuenta que la responsabilidad por el incumplimiento es compartida, tanto para empresarios como los responsables de las acciones, por tanto, es mejor desde el inicio, partir de información real clara y con la seguridad que es la correcta y no estar corrigiendo por el camino, pues siempre será más demorado, costoso y aumenta el riesgo de cometer errores.
Un profesional que comprende la utilidad y funcionamiento de los requisitos legales, cuenta con el conocimiento y autoridad que le permite crecer profesionalmente y demostrar el valor real de su trabajo ante cualquier empresario.
Las exigencias a nivel legal, de la sociedad y de los clientes han incrementado, llevando a las organizaciones a preocuparse por la responsabilidad social, lo que involucra el cuidado del ambiente, de la seguridad y salud de los trabajadores, el cuidado de la información y muchos factores más que se han convertido en un verdadero desafío, puesto que le exige ser mucho más organizado, planeado, estructurado para poder dar respuesta y a adquirir mayor conocimiento; es claro que aunque saben que esto existe, la mayor parte de los empresarios, los líderes de proceso y en general los trabajadores, desconocen la realidad de los requerimientos que le son aplicables y esperan que sea el responsable de implementar el sistema de gestión quien los oriente en este aspecto, que los sistemas de gestión se pongan en marcha optimizando los recursos.

Para conocer las directrices y otorgar los recursos necesarios para la mejora continua del Sistema de Gestión de la Seguridad y Salud en el Trabajo (SG-SST), con el objetivo de mejorar la eficacia de todas sus actividades y el cumplimiento de sus propósitos.
Como el objetivo de la evaluación de la Matriz de Requisitos Legales es verificar el cumplimiento de la normatividad aplicable a la organización, puedes:
• De acuerdo a la Matriz de Requisitos Legales y plan de muestreo seleccionar la normatividad a evaluar, puedes priorizar criterios, clasificarla por temática y según el proceso a evaluar.
• Registrar si se cumple o no con las actividades que dan cumplimiento a los requisitos normativos seleccionados, aquí es importante diseñar la herramienta de tal forma que se unifiquen criterios, es decir, dejar la revisión de actividades que me sirven para verificar el cumplimiento de varios requisitos legales.
• Incluir la evaluación de normatividad adoptada de forma voluntaria.
